This Privacy Policy is between Alley-Oop Studios, LLC (“Eclair,” “we,” “our,” “us,” etc.) and you, the user (“you,” “your,” “yours,” etc.) as it relates to information that identifies, relates to, describes, or is reasonably capable of being associated with or linked to you (“Personal Information”) that we collect, use, store, protect, analyze, modify, delete, and disclose (“Process”) when you use the Eclair application (the “App”). We may freely use publicly available data and deidentified data that may identify, relate, or describe you and such data is not included within the definition of Personal Information.

  1. Personal Information 

We may Process the following categories of your Personal Information: 

  • “Identifiers” such as your real name, alias, postal address, shipping address, username, email address, customer ID, password, IP Address, and telephone number.

  • “Location Information” such as your general geolocation information.

  • “Technical Information” such as your IP Address, operating system, browser type, device ID, and device type.

  • “Historical Information” such as your browsing history, search history, online interactions, and purchase and consumption history on the App.

  • “Preferences” meaning inferences we have drawn from your Personal Information to create a profile about your suspected content preferences.

We do not Process your social security number, taxpayer ID, driver’s license, passport, or other government-issued identification number or document; biometric or genetic information; precise geolocation information; private messages directed to third parties; audio, electronic, visual, thermal, or similar information; employment or educational information; nor protected characteristics such as race, ethnicity, religion, sex, gender, sexuality, citizenship, immigration status, and marital status. Any payments made via our App are processed by third-party payment processors. We do not directly collect or store any payment card information entered through our App, but we may receive information associated with your payment card information (e.g., your billing details).

2. Sources

You may directly provide us with: 

  • Your Identifiers and Location Information through the account registration process

  • Your Identifiers, Historical Information, and Preferences through your search queries; the reviews, ratings, profile information, and other content that you post on the App; and any surveys that we ask you to complete.

  • All categories of your Personal Information through your off-site contacts, interactions, and communications with us such as when you contact customer service by email or when you interact with us on social media.

3. Uses of Your Personal Information

As reasonably necessary, we process:

  • Your Identifiers to register you as a member or otherwise provide access to the App and to notify you of changes to our policies.

  • Your Identifiers, Historical Information, and Preferences to notify you about promotions, specials, new features, content, offers, and changes to the App.

We may also Process all categories of your Personal Information to engage in any of the following business activities: 

  • Provide, analyze, administer, enhance, improve, customize, and personalize the goods and services we offer on the App.

  • Conduct technical research and repairs, ensuring the security and integrity of the App and your Personal Information, and improving and analyzing the App and your Personal Information.

  • Provide customer support such as responding to your customer service inquiries and assisting you with password reset requests.

  • Comply with any applicable law, regulation, legal process, or governmental request.

  • Comply with a legal obligation.

  • Investigate violations of and enforce our App policies.

  • Detect, prevent, investigate, and otherwise address suspected illegal activities. 

  • Protect our legitimate interests and protect against harm to the rights, property, and safety of our users, and any third party.

  • Engage in any other activity with your consent.

4. Disclosure

As reasonably necessary, we may disclose all categories of your Personal Information to the following categories of third parties for any business purpose:

  • Our third-party service providers.

  • Law enforcement authorities, governmental agencies, and private litigants.

  • Potential buyers or successors involved in any reorganization, restructuring, merger, sale, joint venture, assignment, divestiture, dissolution, bankruptcy, liquidation, or other transfer of all or a portion of our assets.

  • Other third parties with your consent.

5. Retention

We may retain all your Personal Information for so long as you maintain an account on the App, and for so long as reasonably necessary to fulfill any business purpose, whichever is longer. We may automatically and/or permanently delete your account and your Personal Information at any time, for any reason. We reserve the right to retain publicly available data and deidentified data indefinitely.


6. Security of Your Personal Information

We take appropriate steps to safeguard and protect your Personal Information against loss, theft, and unauthorized Processing. These steps are designed to provide a level of security appropriate to the risks associated with your Personal Information. No measures can be guaranteed to provide 100% security, so we cannot and do not warrant or guarantee the security of your Personal Information. 

You must protect your Personal Information by using a strong password for your account and keeping that password confidential. The confidentiality of your password is your responsibility to protect. 

By using our App or providing personal information to us you agree that we communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our App. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on our App or by sending an email to you.

7. State-Specific Privacy Rights


California: In the last twelve (12) months, we have not “sold” or “shared” your Personal Information as those terms are defined by the California Consumer Privacy Act. We do not make disclosures of your Personal Information for “direct marketing purposes” as that term is defined by California’s Shine the Light law. If you are a resident of California, you have a right to know the categories of Personal Information that we have collected about you, the sources of your Personal Information, the business purposes that we collected your Personal Information, and the categories of third parties to whom we have disclosed your Personal Information. Such information is laid out in the preceding sections of this Privacy Policy. If you are a resident of California, you also have a right to know the specific pieces of Personal Information that we have collected about you, and you have the right to, no more than twice per year, send us a request by emailing privacy@meeteclair.com to (i) delete your Personal Information, (ii) correct inaccuracies in your Personal Information, and/or (iii) obtain a copy of your Personal Information.


Maryland: If you are a resident of Maryland, you may, no more than once per year, send us a request by sending an email to privacy@meeteclair.com to: (i) confirm whether we are processing your Personal Information, (ii) access your Personal Information, (iii) correct inaccuracies in your Personal Information, (iv) delete your Personal Information, and/or (v) obtain a copy of your Personal Information that is collected by automatic means. We do not maintain a list of third parties to whom we have disclosed your Personal Information. We do not (i) use your Personal Information for targeted advertising, (ii) sell your Personal Information, nor (iii) use your Personal Information for profiling in furtherance of solely automated decisions that results in the provision or denial of certain protected services.


Nebraska: If you are a resident of Nebraska, you may, no more than twice per year, send us request, or appeal a prior request, by sending an email to privacy@meeteclair.com to: (i) confirm whether we are processing your Personal Information, (ii) correct inaccuracies in your Personal Information, (iii) delete your Personal Information, and/or (iv) obtain a copy of your Personal Information that we collect throughout automated means. We do not (i) use your Personal Information for targeted advertising, (ii) sell your Personal Information, nor (iii) use your Personal Information for profiling in furtherance of a decision that results in the provision or denial of certain protected services.


Nevada: We do not meet the triggers of Nevada Revised Statute Chapter 603A. While we do not sell your Personal Information, Nevada residents may submit an opt-out request to privacy@meeteclair.com which we will honor if we sell your Personal Information at a future date.


New Jersey: If you are a resident of New Jersey, you may send us a request by sending an email to privacy@meeteclair.com to: (i) confirm whether we are processing your Personal Information, (ii) correct inaccuracies in your Personal Information, (iii) delete your Personal Information, and/or (iv) obtain a copy of your Personal Information.


Texas: If you are a resident of Texas, you may, no more than twice per year, send us request, or appeal a prior request, by sending an email to privacy@meeteclair.com to: (i) confirm whether we are processing your Personal Information, (ii) access your personal information, (iii) correct inaccuracies in your personal information, (iv) delete your Personal Information, and/or (v) obtain a copy of your Personal Information. We do not (i) use your Personal Information for targeted advertising, (ii) sell your Personal Information, nor (iii) use your Personal Information for profiling in furtherance of a decision that results in the provision or denial of certain protected services.


8. Privacy Rights of Non-U.S. Residents


The General Data Protection Regulation 2016/679 (GDPR) grants certain rights to individuals in the EU related to our processing of their Personal Information. Under the GDPR, we are the data controller of your Personal Information, and you may contact us at privacy@meeteclair.com. The purposes of our processing are set out in the Use of Your Personal Information section of this Privacy Policy. 


The lawful basis for our processing of Personal Information that you provide to us is to perform or take steps to perform a contract with you (e.g., provide a service) and the Personal Information you provide is necessary to provide the service. As to marketing communications, the lawful basis for us to transmit those communications to you is your consent to receive those communications, which you can withdraw at any time. 

The lawful basis for the processing of Personal Information that we collect automatically is our legitimate interest in delivering the App services to you and monitoring and improving our App and service offerings. 

We are headquartered in the U.S. and we process Personal Information in the U.S. We establish appropriate and suitable safeguards for the processing of your Personal Information. 

We maintain your Personal Information so long as you keep an account with us. You have the right to request access to and rectification of your Personal Information, which you may exercise at any time by emailing privacy@meeteclair.com. To have your Personal Information deleted, please log into your account and follow the procedures for deleting your Personal Information 

If you have a complaint about our handling of your Personal Information, you may lodge a complaint with the appropriate supervisory authority. 

If you have an unresolved privacy or data use concern that we have not addressed satisfactorily, please contact us at privacy@meeteclair.com.

9. Changes to the Privacy Policy

We reserve the right to change, modify, or amend this Privacy Policy at any time, without prior notice, for any reason, including in response to changing legal, regulatory, or operational requirements. We encourage you to check this Privacy Policy periodically for any changes. You are responsible for regularly reviewing this Privacy Policy and your continued use of the App constitutes your acknowledgement and acceptance as to all such changes. If you do not agree to the terms of this Privacy Policy, then do not use the App and deactivate your account. To find out when this Privacy Policy was last updated, please see the “Last Updated” notice at the top of this page.
